1. Acceptance of Terms

By accessing or using CardOutpost, available at cardoutpost.com (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, you must not access or use the Platform. These Terms constitute a legally binding agreement between you and Conquest Labs LLC ("CardOutpost," "we," "our," or "us"). Your continued use of the Platform following any modification to these Terms constitutes your acceptance of those modifications. The CardOutpost Privacy Policy, AML/KYC Policy, Responsible Gaming Policy, and any Promotions Official Rules are incorporated by reference.

2. Eligibility

You must be at least 18 years of age (21 years of age in states where required), or the age of majority in your jurisdiction (whichever is greater), to use the Platform. The Platform is offered primarily to residents of the United States, and is also available to non-U.S. residents to the extent permitted under the laws applicable to them and the jurisdictions in which we operate. You must be located in a jurisdiction in which we offer the Platform. We use geolocation tools to verify eligibility, and the use of VPNs, proxies, or other tools to mask your location or circumvent these checks is prohibited and is grounds for immediate account termination and forfeiture of balances. By creating an account or using the Platform, you represent and warrant that you meet each of these eligibility requirements. If you do not meet these requirements, you must not use the Platform. We reserve the right to request proof of age, residency, or location at any time and to suspend or terminate accounts that we reasonably believe are operated by individuals who do not meet these eligibility requirements. You are also responsible for ensuring that your use of the Platform complies with all laws and regulations applicable in your jurisdiction.

3. Account Registration

To access most features of the Platform, you must register for an account. You agree to:

You are solely responsible for all activities that occur under your account. CardOutpost is not liable for any losses arising from unauthorized access to your account resulting from your failure to safeguard your credentials.

4. Platform Description & Balances

CardOutpost is a digital collectible card pack-opening platform operated by Conquest Labs LLC. Users deposit funds, purchase virtual packs containing randomized trading cards, and may sell cards back to the Platform for site credit. Pack pulls are determined by randomized algorithms with weighted odds. CardOutpost does not guarantee any specific card, rarity, or value from a pack opening.

The Platform maintains two distinct balances:

All items obtained through pack openings are virtual and exist within the Platform ecosystem unless converted to Earnings Balance through the sell-back feature. Users may also request physical shipment of certain virtual cards from their Collection, subject to availability. Standard shipping is USD 10. Delivery can take up to 4 weeks from order confirmation due to stock and supply chain constraints. Users will receive tracking information once dispatched. CardOutpost is not liable for shipping delays caused by supplier shortages. Risk of loss passes to the user upon delivery.

Users may withdraw Earnings Balance via PayPal or Wise, subject to:

Withdrawals are processed manually within 24–48 hours. First-time withdrawals and withdrawals requested within 72 hours of a deposit may be subject to additional security review and holding periods. The minimum withdrawal is USD 10. We reserve the right to return deposits to the original payment method via refund before processing e-wallet withdrawals for the net deposit amount.

We reserve the right to deny or hold any withdrawal where we detect behavior consistent with fraud, money laundering, or abuse.

Tax Reporting and Information Returns. CONQUEST LABS LLC may be required to report withdrawal payments to the U.S. Internal Revenue Service (IRS) and to applicable state tax authorities. By requesting a withdrawal, you agree to provide a complete and accurate IRS Form W-9 (for U.S. persons) or Form W-8BEN / W-8BEN-E (for non-U.S. persons), including a valid taxpayer identification number, upon our request. If your aggregate withdrawals in any calendar year meet or exceed the applicable IRS reporting threshold (currently USD 600), we may issue you a Form 1099 (or other applicable information return) and file a copy with the IRS. We may apply backup withholding to your withdrawals at the rate then required by law if you fail to provide a valid Form W-9 or if otherwise required. You are solely responsible for the accuracy of the tax information you provide and for the reporting and payment of any taxes on amounts you receive through the Platform. We do not provide tax advice and recommend you consult a qualified tax advisor regarding your obligations.

7. Deposits & Payments

Deposits are processed via Stripe using fiat currency (USD) only. We do not accept cryptocurrency, prepaid cards not registered to the user, peer-to-peer transfers, or third-party payment services. Deposits are non-refundable once credited to your account, except as required by applicable law or in the case of a genuine duplicate charge caused by a system error. The minimum deposit is USD 1. There is no hard maximum, but large or rapid deposits may trigger a brief security review.

You agree not to engage in any of the following prohibited activities. Violations may result in immediate account termination, forfeiture of your entire Pack Balance, Earnings Balance, and virtual card collection, and potential legal action:

9. Intellectual Property

CardOutpost and its underlying technology, software, design, and branding are owned by Conquest Labs LLC and are protected by applicable intellectual property laws. Trading card names, images, characters, and associated intellectual property displayed on the Platform belong to their respective owners, including but not limited to The Pokémon Company International, Wizards of the Coast LLC, and Konami Holdings Corporation. CardOutpost does not claim ownership over any third-party intellectual property. Your use of the Platform does not grant you any license or right to use any CardOutpost or third-party intellectual property beyond what is strictly necessary to use the Platform as intended.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, CARDOUTPOST DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY CARD VALUES, MARKET DATA, OR OTHER INFORMATION DISPLAYED ON THE PLATFORM. YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CARDOUTPOST, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR INTERRUPTION OF BUSINESS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL CARDOUTPOST’S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM EXCEED THE TOTAL AMOUNT YOU PAID TO CARDOUTPOST DURING THE TWELVE (12) MONTH PERIOD IMMEDIATELY PRECEDING THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless CardOutpost, Conquest Labs LLC and their respective officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the Platform; (c) your violation of any third-party rights, including intellectual property rights; or (d) your violation of any applicable laws or regulations.

13. Dispute Resolution

These Terms and any disputes arising out of or related to your use of the Platform shall be governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict of law provisions.

PLEASE READ THE FOLLOWING CAREFULLY. IT AFFECTS YOUR RIGHTS. Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved exclusively through final and binding individual arbitration, rather than in court. You waive your right to participate in any class action lawsuit or class-wide arbitration. The arbitration shall be conducted by a single arbitrator in accordance with the rules of a recognized arbitration body, and judgment on the award may be entered in any court of competent jurisdiction. If for any reason a dispute proceeds in court, you and CardOutpost irrevocably submit to the exclusive jurisdiction of the state and federal courts located in Wyoming.

Notwithstanding the above, CardOutpost may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights.

14. Termination

CardOutpost reserves the right to suspend or permanently terminate your account, at our sole discretion and without prior notice, for any violation of these Terms or for any conduct we determine to be harmful to the Platform, other users, or our business. Upon termination for cause, including chargebacks filed without prior support contact, fraud, multi-accounting, money laundering, or circumvention of security controls, you forfeit any remaining Pack Balance, Earnings Balance, and virtual card collection without compensation. We reserve the right to retain forfeited balances to offset chargeback fees, dispute costs, and regulatory penalties. You may request deletion of your account at any time by contacting us at support@cardoutpost.com. Account deletion requests will be processed within 30 days, subject to our data retention obligations. Provisions of these Terms that by their nature should survive termination will continue to apply after termination.

15. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you by email or through a notice on the Platform. Your continued use of the Platform after any changes become effective constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
